Finding bankruptcy filings in title searches should raise a number of red flags. A property owner’s bankruptcy adds wrinkles to a real estate transaction but also offers opportunities that don’t exist otherwise outside of bankruptcy. This review identifies important issues that can derail your transaction and offers practical advice for how to address them. Topics include the significance of what type of bankruptcy has been filed, important deadlines and other timing requirements when real estate is involved, identifying applicable – and inapplicable – exemptions, and dealing with the bankruptcy trustee.
