“Can You Trust a Prenup?”

Just because a prenuptial is “ironclad” does not necessarily mean it is litigation-proof.
In fact, marital agreements are one of the most litigated areas of the law, which can
be expensive not only for the more affluent spouse, but also for the attorney who
prepared the agreement. Given that marital agreements cover both death and divorce,
probate and family law attorneys alike should be familiar with basic statutory requirements,
common drafting mistakes, and methods for setting agreements aside.
